1. Agreement and operator
These Terms of Use ("Terms") are an agreement between you and KSD Inc., an Ontario corporation with its registered office at 4889 A Dundas Street West, Suite 3, Etobicoke, Ontario, M9A 1B2, Canada ("KSD Inc.", "we", "us"). They govern your use of the Khartes mobile application and related services. By using Khartes, you agree to these Terms. If you do not agree, do not use the App.
2. What Khartes provides
Khartes is a journey-planning companion. It can keep separate journey plans open, combine and optimize stops, compare traffic-based departure predictions, search for places, and prepare a route for handoff to Google Maps.
Khartes does not provide turn-by-turn navigation, emergency services, professional transportation advice, or guaranteed traffic, fuel-price, business-hour, or place information. Google Maps owns navigation after handoff, including spoken directions, rerouting, lane guidance, traffic incidents, and supported in-car experiences. Khartes cannot read or silently modify an independent Google Maps session.
3. Safe and lawful use
Do not interact with Khartes while driving unless the interaction is lawful and can be completed safely, such as through an appropriate hands-free feature. Pull over when attention is required. You remain responsible for observing road signs, closures, conditions, laws, and official instructions. Never rely on Khartes for emergency response or a safety-critical decision.
4. Eligibility and accounts
Khartes does not require a conventional account or login. You must be legally capable of agreeing to these Terms. If you use Khartes on behalf of an organization, you represent that you have authority to bind that organization. Store-family or guardian controls may apply to purchases and app access.
5. Free access, subscriptions, and allowances
Khartes is free to download and offers Free, Plus, and Max access levels. Paid plans are sold as auto-renewing subscriptions through the Apple App Store or Google Play. The price and currency shown by your store at purchase are controlling. Subscriptions renew automatically unless cancelled through your store account before the end of the current billing period, subject to the store's rules.
Each access level has stated limits for stops and certain provider-backed actions. Monthly action counts are upper limits, not a promise that every possible maximum-cost action can be combined in one month. A shared provider-cost safety ceiling may stop an unusually expensive mix sooner. Khartes shows applicable usage and renewal timing in the App. When an allowance is exhausted, the affected action may remain unavailable until the next reset or an eligible upgrade; other available features remain usable.
Purchases, renewals, cancellations, billing issues, and refunds are administered by the applicable store under its rules. Use Restore Purchases to restore an eligible subscription. We do not receive your full payment-card details and cannot issue a store refund directly.
6. App license and platform terms
Subject to these Terms, KSD Inc. grants you a limited, personal, revocable, non-exclusive, non-transferable license to use Khartes for its intended purpose. The platform's terms also apply. For an Apple-distributed copy, Apple's Standard Licensed Application End User License Agreement governs the licensed application. Store transaction terms control where they conflict with these Terms on payment, cancellation, or refund administration.
7. Acceptable use
You must not:
- use Khartes for unlawful, fraudulent, harmful, or abusive activity;
- attempt to bypass usage allowances, subscription checks, provider safeguards, or security controls;
- reverse engineer, scrape, overload, disrupt, or gain unauthorized access to Khartes or its services except where applicable law expressly permits;
- use provider content outside the functionality and licenses made available through Khartes;
- misrepresent Khartes output as guaranteed, official, or suitable for emergency use.
8. Your journey data
You remain responsible for journey information you enter or select. Khartes stores journeys locally and has no cloud journey sync. You grant us and our service providers only the limited rights needed to process the place, route, location, voice-text, and transaction information required to perform the action you request, operate allowances, protect the service, and comply with law. Our handling of information is described in the Khartes Privacy Policy.
9. Third-party services and content
Khartes depends on services and information supplied by Google, OpenStreetMap contributors and a hosted OSM service, Anthropic, Supabase, RevenueCat, Vercel, Apple, and Google Play. Third-party terms may apply. Place, route, traffic, opening-hour, rating, and fuel-price information may be delayed, incomplete, unavailable, or inaccurate. Khartes does not guess missing or stale fuel prices, but verification rules cannot guarantee real-world accuracy.
10. Service changes and availability
Internet access and functioning third-party services are required for provider-backed features. We may change, suspend, limit, or discontinue features to maintain safety, comply with provider terms or law, manage finite capacity, address security issues, or improve Khartes. We do not guarantee that every feature or provider will be available at all times or in every region.
11. Intellectual property
Khartes, its design, software, branding, and original content are owned by KSD Inc. or its licensors and are protected by applicable law. Google Maps and related Google marks belong to Google. OpenStreetMap data is attributed to OpenStreetMap contributors and is subject to the Open Database License. No rights are granted except the limited license stated in these Terms.
12. Disclaimers
To the maximum extent permitted by law, Khartes and its related services are provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, KSD Inc. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, opportunity, or use, arising from Khartes. Our aggregate liability for a claim relating to Khartes will not exceed the greater of the amount you paid for Khartes during the twelve months before the event giving rise to the claim or CAD $50. This limitation does not apply where prohibited by law.
14. Suspension and termination
We may restrict access to provider-backed services when reasonably necessary to address misuse, security, legal, provider, payment, or capacity concerns. You may stop using Khartes at any time by deleting it, but deleting the App does not cancel an active subscription; cancel through the applicable store.
15. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere. Nothing in these Terms limits non-excludable rights under the law where you live.
16. Changes to these Terms
We may update these Terms as Khartes, provider requirements, or applicable law changes. We will post revised Terms here and update the date above. Material changes will be communicated where required.
